Mediation Process

Readiness Assessment
A conversation to determine the nature of the conflict, the parties to the conflict, the appropriateness of mediation as a means to resolve the conflict. This assessment helps the parties and Kate determine whether Kate is the best mediator to support the parties in this process.
Intake
Each party to the conflict will be contacted to explain the mediation process, to confirm consent to participate in the mediation with Kate, and to schedule the mediation. Parties will be invited to provide any documents that they would like reviewed in advance.
Mediator Preparation
Any documents that the parties would like the mediator to review in advance should be submitted to the mediator 72 hours prior to the mediation. Any documentation received after this point will not be reviewed in advance of the mediation.
Please be reminded that Kate is not an arbiter, or a fact finder. Therefore, documents need to be pertinent to resolving the issues in this mediation. Excessive documents are not necessarily persuasive, and they will only be reviewed when needed.

Mediation
Kate meets with the parties in order to facilitate an agreement between the parties on the issues.
Post Mediation
During the mediation or shortly thereafter, Kate will draft an agreement of the issues resolved during the mediation. The parties will sign the mediated agreement, which serves as a binding contract for all parties.

Mediation Fees
To be upfront about costs and fees, please read the following information.
Kate provides mediation services for trust & estate conflicts and for health care decisions at $300 hourly. Please be advised that in addition to actual mediation time, which is generally 1.5-3 hrs. Every mediation generally require additional time/fees, such as intake for each party (0.25), mediator preparation (0.5-2 hrs), and post mediation (0.5-2 hrs). Depending upon the location and situation, fees may include covering the costs for a mediation meeting room and/or travel.
